The instant appeals, though involving two separate cases, result from a consolidated trial arising out of a common crime and
involve essentially identical issues. For that reason, we have elected to, likewise, consolidate the two cases for purposes
of our decision. On July 1, 1977, appellants, Peter Hochstein (Hochstein) and C. Michael Anderson (Anderson), were separately charged by information
in the county court of Douglas County, Nebraska, with first degree murder in the death of Ronald J. Abboud (Abboud). Hochstein
and Anderson were bound over to the District Court for Douglas County, Nebraska, which, after consolidating the matters, heard
and ruled on numerous pretrial motions, some of which are involved in this appeal. After trial, both appellants were found
guilty as charged and sentenced by a three-Judge panel to be executed. Hochstein and Anderson both appeal from the conviction
and sentence, assigning a number of errors which we shall individually discuss hereafter. We have, however, carefully and
meticulously reviewed this matter and conclude that it is, in all respects, correct. We, therefore, affirm both the conviction
and the sentence.
